10DLC Messaging Service Terms and Conditions

These Terms and Conditions ("Agreement") govern the use of the 10DLC messaging service ("Service"). By accessing or using the Service, you ("User," "you," or "your") agree to comply with and be bound by these Terms and Conditions.
1. Service Description The 10DLC messaging service allows users to send SMS (Short Message Service) and MMS (Multimedia Messaging Service) messages using 10-digit long codes ("10DLC") for communication with recipients. The Service may be used for marketing, customer support, transactional messages, or other lawful business activities.
2. User Responsibilities a. Compliance with Laws: You agree to use the Service in compliance with all applicable laws, regulations, and guidelines, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any other relevant local, state, or federal laws. b. Message Content: You are responsible for the content of all messages sent through the Service. The content of your messages must not include illegal, offensive, defamatory, or spammy material, and must comply with the rules set forth by the Mobile Marketing Association (MMA) and other industry standards. c. Recipient Consent: You agree to obtain the appropriate consent from recipients before sending messages via the Service. You are responsible for maintaining records of opt-in and opt-out consent from all recipients.
3. Service Fees a. Pricing: You will be charged fees for using the Service as specified in your plan or agreement. These fees may include charges for sending messages, receiving messages, or using certain features of the Service. b. Billing: The Service provider reserves the right to change its pricing at any time. Any changes will be communicated to you in advance, and billing will occur based on the updated pricing.
4. Restrictions on Use You agree not to use the Service to: a. Send unsolicited commercial messages (spam). b. Violate the privacy of any individual, including sending messages to people who have not opted in. c. Send harmful, abusive, or discriminatory messages. d. Engage in any illegal activity, including fraud, harassment, or illegal marketing practices. e. Impersonate any person or entity or mislead recipients about the origin of the messages.
5. Number Registration and Compliance a. 10DLC Registration: You must register your 10DLC number before using it for messaging. The Service provider may require you to provide certain information during the registration process, including your business details, intended use of the number, and other necessary documentation. b. Use of Registered Numbers: You agree not to use the Service with unregistered or improperly registered 10DLC numbers. The Service provider reserves the right to suspend or terminate your access to the Service if the registration is found to be non-compliant with applicable rules.
6. Termination of Service a. Termination by You: You may terminate your use of the Service at any time by notifying the Service provider. However, fees will still apply for any messages sent or services rendered prior to the termination. b. Termination by Service Provider: The Service provider may suspend or terminate your access to the Service if you violate these Terms and Conditions, engage in unlawful activities, or fail to pay for services as agreed.
7. Privacy and Data Security a. Privacy: The Service provider respects your privacy and is committed to protecting your data. We will not disclose your personal information to third parties without your consent, except as required by law or for the provision of the Service. b. Data Security: The Service provider will use commercially reasonable efforts to maintain the security and integrity of your data while it is in our possession.
8. Limitations of Liability a. No Warranties: The Service is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. b. Limitation of Liability: The Service provider will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Service, even if the Service provider has been advised of the possibility of such damages.
9. Indemnification You agree to indemnify and hold harmless the Service provider, its affiliates, officers, directors, and employees from and against any claims, damages, liabilities, losses, and expenses arising from your use of the Service, including but not limited to any violation of these Terms and Conditions.
10. Modifications to the Terms The Service provider reserves the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to you via email or through the Service. Continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms and Conditions.
11. Governing Law These Terms and Conditions are governed by the laws of the state of Florida, United States, without regard to its conflict of law principles. Any disputes arising from or related to these Terms and Conditions will be resolved in the courts located in the state of Florida, United States.
